Interpretation
The words of which the initial letter is capitalized have meanings defined under the following conditions. The following definitions shall have the same meaning regardless of whether they appear in singular or in plural.

For the purposes of these Terms and Conditions:

This Terms and Conditions agreement incorporates content created with the help of a Terms & Conditions generator and has been customized for Lotus Arts Center.

Purchases and Payments
When you purchase goods, artworks, tickets, or services (such as workshops) through our Site or via our authorized partners, you agree to provide accurate payment and billing information. All purchases are subject to availability and acceptance by the Company.
- Payment processors: We use secure third-party payment processors (for example Stripe, PayPal, or similar). By completing a transaction you authorize us and our payment processors to charge your chosen payment method.
- Pricing: Prices are listed in U.S. dollars unless otherwise noted and may change without notice. Taxes, shipping, and handling fees may apply where indicated at checkout.
- Order confirmation: After placing an order you will receive an order confirmation by email. This does not necessarily constitute acceptance of your order; acceptance occurs when we ship the product or confirm a class/event registration.
Shipping, Refunds & Cancellations
Separate Shipping, Refund, and Cancellation policies apply and are posted on the Site. In summary:
- Shipping for products: Physical items will be shipped according to our Shipping Policy and estimated delivery windows. Shipping times are estimates and not guaranteed.
- Returns & refunds for goods: Refunds for eligible merchandise are issued per our Refund Policy. Some custom or handmade items may be final sale—details for each product are provided at purchase.
- Workshops & events: Refunds and cancellations for classes, workshops, or events follow our Event Cancellation Policy. We make best efforts to notify registrants of cancellations or rescheduling.
- How to request a refund: Contact us at info@lotusartscenter.org with your order details. Refunds are processed to the original payment method when applicable.
User Accounts
To access certain features or purchase items you may need to create an account. You are responsible for maintaining the confidentiality of your account login information and for all activity that occurs under your account.
You agree to notify us immediately of any unauthorized use of your account or any other breach of security. We reserve the right to suspend or terminate your account if you violate these Terms or for any other reason at our discretion.
User-Generated Content
The Service may allow users to create, upload, post or submit content such as artwork images, comments, reviews, profiles, and other materials ("User Content"). By submitting User Content you represent and warrant that you own or have the right to post such content and that it does not violate any law or third-party right.
By submitting User Content, you hereby grant Lotus Arts Center a non-exclusive, royalty-free, perpetual, irrevocable, worldwide license to use, reproduce, modify, adapt, publish, translate, distribute, publicly perform and display such content for the purposes of operating, improving, promoting and publicizing Lotus Arts Center and the Services (including without limitation on the Website, social media, marketing materials, exhibitions, and promotions). You also grant other users the right to view and share your content where the Service allows.
We do not claim ownership of your User Content. However, by posting content you grant the above license to the Company. We may remove or refuse to display any User Content at our discretion, including content that violates these Terms, is offensive, or otherwise inappropriate.
Prohibited Content
You must not post content that:
- Infringes any third-party intellectual property or privacy rights;
- Is unlawful, defamatory, obscene, abusive, hateful, or threatening;
- Contains viruses or other harmful code;
- Is commercial advertising or spam unless expressly permitted by the Service;

All content on the Site, including our name, logo, trademarks, text, images, designs, icons, photographs, videos, and the look and feel of the Site, is the exclusive property of Lotus Arts Center or its licensors (unless otherwise noted).

Feedback & Suggestions
If you provide suggestions, ideas, feedback, or other proposals (“Feedback”), you acknowledge and agree that Lotus Arts Center may use such Feedback without any obligation to you. By submitting Feedback you grant the Company a non-exclusive, perpetual, irrevocable, royalty-free, worldwide license to use, reproduce, modify, publish, translate, create derivative works from and distribute such Feedback for any purpose.
Promotions, Contests & Sweepstakes
From time to time we may run promotions, contests, or sweepstakes. Specific rules, eligibility requirements, and additional terms (if any) will be posted with each promotion. Participation is voluntary and may require you to provide personal data (name, email, images, etc.).
By participating you agree to the rules of the promotion and these Terms. Promotions may be governed by additional legal rules; where there is a conflict, the specific promotion rules will control for that promotion.

Our Service may contain links to third-party websites and services that are not owned or controlled by Lotus Arts Center. We are not responsible for the content, privacy practices, or terms of use of those third parties. You should review the terms and privacy policies of third-party sites before using them.

We collect and use personal information in accordance with our Privacy Policy. Please review our Privacy Policy for details on what information we collect, how we use it, and your rights with respect to your personal data. The Privacy Policy is incorporated into these Terms by reference.
Promotional Emails & Communications
By creating an account or opting into communications you may receive emails about events, classes, promotions, and news. You can opt out or update your communication preferences at any time by following the unsubscribe link in our emails or contacting us at info@lotusartscenter.org. Opting out of marketing emails does not prevent important transactional messages (order confirmations, event notifications) related to services you purchased.
Disclaimer of Warranties
The Service is provided to You "AS IS" and "AS AVAILABLE" and with all faults and defects without warranty of any kind. To the maximum extent permitted under applicable law, Lotus Arts Center disclaims all warranties, express or implied, including merchantability, fitness for a particular purpose, title and non-infringement.
Limitation of Liability
Notwithstanding any damages that You might incur, the entire liability of the Company and any of its suppliers under any provision of this Terms and Your exclusive remedy for all of the foregoing shall be limited to the amount actually paid by You through the Service or 100 USD if You haven't purchased anything through the Service.
To the maximum extent permitted by applicable law, in no event shall the Company or its suppliers be liable for any special, incidental, indirect or consequential damages whatsoever.
Some jurisdictions do not allow the exclusion of implied warranties or limitation of liability for incidental or consequential damages; in such jurisdictions, liability is limited to the greatest extent permitted by law.
Governing Law
These Terms and Your use of the Service shall be governed by and construed in accordance with the laws of the Country (Minnesota, United States), excluding its conflicts of law rules. Your use of the Service may also be subject to other local, state, national, or international laws.
Dispute Resolution
If you have any concern or dispute about the Service, you agree to first try to resolve the dispute informally by contacting the Company at info@lotusartscenter.org. If the dispute cannot be resolved informally, the parties may pursue any remedies available under applicable law.
For European Union (EU) Users
If You are a European Union consumer, you will benefit from any mandatory provisions of the law of the country in which You are resident.
United States Legal Compliance
You represent and warrant that (i) You are not located in a country that is subject to the United States government embargo, or that has been designated by the United States government as a "terrorist supporting" country, and (ii) You are not listed on any United States government list of prohibited or restricted parties.
Severability and Waiver

If any provision of these Terms is held to be unenforceable or invalid, such provision will be changed and interpreted to accomplish the objectives of such provision to the greatest extent possible under applicable law and the remaining provisions will continue in full force and effect.
Waiver
Except as provided herein, the failure to exercise a right or to require performance of an obligation under these Terms shall not affect a party's ability to exercise such right or require such performance at any time thereafter nor shall the waiver of a breach constitute a waiver of any subsequent breach.
Translation Interpretation
These Terms and Conditions may have been translated if We have made them available to You on our Service. You agree that the original English text shall prevail in the case of a dispute.
Changes to These Terms and Conditions
We reserve the right, at Our sole discretion, to modify or replace these Terms at any time. If a revision is material We will make reasonable efforts to provide at least 30 days' notice prior to any new terms taking effect. What constitutes a material change will be determined at Our sole discretion.
